JobSpring is a website that connects people who are looking for work and others who have jobs to offer. The service offers both employers and employees the opportunity to find flexible opportunities in their desired location, with JobSpring’s online platform acting as an intermediary between them. This Terms of Service Agreement outlines all details related to this agreement.
Your JobSpring Account. If you create an account on the Service (your “Account”), it’s your responsibility to maintain proper security for that information and any other activity taken by or through this site, including all of its tools and services; we don’t want anyone else accessing anything without permission from you. Do not describe or assign Content to your Account in a misleading or unlawful manner, including in a manner intended to trade on the name and reputation of others. JobSpring may change any description that it considers inappropriate under these guidelines as well as remove keywords deemed unsuitable for use by this site. You should also immediately notify us if you ever notice anything unauthorized being done with your account so we can take appropriate action and make sure no one else is able to do anything they shouldn’t be doing either. JobSpring will not be liable for any mistakes made by you, including damages incurred from those mistakes.
Fees and Renewals
There will be no refunds or credits for partial months of job postings. If you are on a monthly subscription plan, please remember to update your account every month.
It is important to consider that the customer be responsible for all taxes and fees associated with their purchase of our Service. It is also imperative when selling goods or services under these Terms, you are aware if any sales tax applies on your transactions so it can be collected appropriately from you and remitted properly for payment.
You are solely responsible for the content of your work. If you post anything that is harmful to other people, or even if it’s just not what they wanted from you, then don’t be surprised when someone complains about it and asks us to take down their post. We’re sorry we have to do this but as a website with such high traffic volume, there will always be some bad apples in charge of making sure our site stays clean.
The downloading, copying and use of the Content will not violate any third party’s rights, the proprietary right including but not limited to copyright.
You must have permission from your employer or a waiver to post any of the intellectual property that you created. This includes all software, documents, drawings and other forms of content on this website.
If I create an article for my company’s blog without explicit approval then they could claim ownership over it which means that in order to publish anything onto our site I would need their written permission first.
In an effort to ensure that the Content does not contain or install any viruses or other harmful content, we have taken measures such as: (i) making sure that there is no spam present in our emails and texts. In order for you to be able to receive your messages with ease, all of these communications will only come from one specific email address; (ii) ensuring that nothing on this site was randomly generated by a machine. We know how frustrating it can be when something appears unsolicited so everything here has been created exclusively by humans like us (humans who are also trying their best); and (iii) avoiding unethical commercial content which might lead people somewhere they don’t want to go—namely, places where malicious links could possibly steal credit card numbers or sell.
The Content is not obscene, libelous or defamatory, hateful or racially or ethnically objectionable. It does not violate the privacy and publicity rights of any third party; your Account will never be advertised via spam links on newsgroups, email lists, other blogs and web sites etc.
The content mustn’t contain anything deemed to be obscene by Facebook standards (promotions won’t advertise themselves), libelous towards anyone else nor discriminatory against people because of their race/ethnicity. You also have complete discretion over how much information you share with others.
Your Account should reflect your own personal brand. For example, don’t use someone else’s name or company as the account URL and make sure to accurately describe what type of content you are uploading so that others can quickly understand its context..
By uploading Content or otherwise providing Content to JobSpring, you grant us the right to use (including the right to host, index, cache and format) your content in connection with providing service as well as on our website.
JobSpring reserves the right to refuse or remove any Content and terminate your account for any reason whatsoever. Please read our Community Guidelines for rules on what types of content are appropriate at JobSpring, as well as tips regarding what type of use is most approved by other members in order to avoid being banned from using this site’s services. JobSpring has the power to restrict, ban access/use cases that do not comply with their guidelines from accessing its website and network.
All content uploaded are copyright by their respective owners.
If you delete content available through this site (also known as “Content”), we’ll try to get rid of it by removing them from the service altogether so they’re not accessible anymore; but bear in mind that because caching systems may still retain a copy for very limited periods after deletion is requested.
Third-party Websites and Content
The websites we have not reviewed and cannot review are too many to count. We Work Remotely has no control over the other remote working sites, but they should be aware that their content may differ from ours in some way or another. We can’t vouch for anything outside our own domain though; if you’re interested in those links it might be worth your time investigating them first before coming back.JobSpring is committed to protecting your privacy. We do not endorse any website or webpage that we link you too and are not responsible for the content on those sites, nor will they be liable if a virus infects your computer from visiting them. You should always take precautions when surfing the web safely by using anti-virus software and staying away from questionable links (viruses can come in many forms). By linking websites outside of JobSpring’s system, such as LinkedIn profiles, it does not imply an endorsement on our part; instead we provide this information so you have all available tools at hand during job searches.
All material available on the Service and all materials provided by or through JobSpring, its affiliates, subsidiaries, employees agents licensors, or other commercial partners including but not limited to the software are owned by us or our licensors or service providers and are protected by copyright, trademark, trade secret and other intellectual property laws. All service available on the website as well as any services offered by employers via Jobspring is proprietary. All of these entities can use anything you post online without your consent. Subject to your compliance with the Terms, during our term of service we grant you a limited-purpose right to access and use any materials that we make available.
JobSpring may take action to preserve the security and confidentiality of your data if it deems there is an immediate risk. The suspension does not breach our Terms, but JobSpring assumes no liability for any damage or loss that may result from this decision.
This section does not apply to Content; however you agree that any ideas, suggestions, concepts, processes or techniques which you provide to JobSpring related to the Service or JobSpring are and will be our exclusive property without compensation for your time. Feedback you provide to JobSpring is valuable and we always want to make sure to use it in the best way possible. But, sometimes this can mean that your feedback may be used for something other than what was originally intended or create a conflict of interest with another project.
JobSpring retains the right to use or share any Aggregated Data generated by anyone using the Service. This data is used for improving and providing a better service, but it does not contain personal information. If you choose to connect your lead account with services from third-party providers then JobSpring may share that data with them as well. This means that any information you share online is up to you.
JobSpring reserves the right, at its sole discretion, to modify or replace any part of the Terms. It is your responsibility to check JobSpring’s website periodically for changes in terms and policies relating to our service offerings including new features that may be offered. You continue use of or access to Jobspring’s Service following posting on Jobspring’s site constitutes acceptance by you such revised Terms and Conditions as posted online from time-to-time when they become effective.
Disclaimer of Warranties
The content of the Service is at your sole responsibility and risk. You are agreeing that you will not hold any party accountable for anything related to these terms, including but not limited to service interruptions or data loss. JobSpring expressly disclaims all representations, warranties or conditions of any kind with respect to the Service including but not limited to any implied warranty that is merchantable, fit for a particular purpose and accurate. JobSpring does however make no guarantees concerning performance failures due to system integration issues.
The service is offered and controlled by JobSpring from its facilities in the Philippines. JobSpring makes no representations that the service is appropriate or available for use in locations other than the Philippines and countries where the service is available. Those who access or use the Service from other jurisdictions do so of their own volition and are responsible for compliance with local law. We handle complaints of copyright infringement in accordance with our Copyright Policy.
Limitation of Liability
JobSpring does not hold any liability for indirect, incidental, special consequential damages or losses. They will only be held liable if we are negligent and you can prove it in a court of law. This means Jobspring will only be responsible when there has been clear negligence present- meaning they should have known about your situation beforehand and acted accordingly with no fault on your part; once this condition falls out it becomes more difficult to find them at least partially negligent given all conditions were met by both parties involved without outside influence or force being applied during use.
JobSpring will provide the service you need and support if anything should go wrong. It is limited to your one year with them, but they are not liable for any consequential or incidental damages in those regions which do not allow the exclusion of liability. Notwithstanding the foregoing or anything else herein to the contrary, JobSpring will not be liable to you or any third party acting on your behalf in any way with respect to a trial program. You further agree that these limitations will apply with respect for liability of all kinds from one source and another alike.
JobSpring takes great care to ensure that all of the content and services provided on its site are high quality. However, you must be aware that any losses incurred by reason of third party sites or advertisements will not fall under JobSpring’s responsibility or liability.
We will not allow you to join a class-action lawsuit. You also give up your right to have a trial by jury if any disputes arise out of or are related to our service and/or the Terms. If these terms don’t work for you, please close this page now without accepting them because once they’re accepted, that’s it.
##General Representation and Warranty
You represent and warrant that your use of the Service will be in strict accordance with all applicable laws. This includes without limitation any local law or regulation regarding online conduct, acceptable content, and technical data exported from the country you reside to other countries. You will not infringe or misuse the intellectual property rights of any third party.
You agree to indemnify, defend and hold harmless JobSpring (and its subsidiaries), affiliates, co-branders all third party advertisers; technology providers service providers or other partners and each of their respective officers directors agents shareholders employees representatives from any claim loss damage cost liability incurred by made against the Indemnified Parties. The claims process will be set out in detail with all the necessary documentation relating to any claim. For a dispute resolution, if this includes an allegation of misuse or violation by you that is not resolved through our internal complaint handling procedures outlined above, we may elect arbitration as your sole and exclusive remedy for such Claim; however there are exceptions which include intellectual property rights violations where applicable law requires us use court proceedings instead of mediation or other non-judicial forms of dispute resolution.
JobSpring agrees to defend you against any legal claims that may arise from your work for them. However, if they spend more than a certain amount of money defending you and have not been able to recover the costs or settle with the plaintiff in question by mutual agreement within two years after being notified of such events as required then JobSpring will become liable for those expenses instead.
If there is any dispute between you and JobSpring about or involving the Terms, Services, or anything else for that matter; we want to make sure it gets resolved fairly. Therefore this Agreement will be governed by Philippine law which means disputes won’t fall under a different legal system.
We will always refer to the Philippines’ responsible agency for any disputes that arise out of or in connection with our terms. All disputes arising out of or in connection with the Terms will be referred to and finally resolved by arbitration under the rules that are adopted for determining who is responsible for certain types of lawsuits. The appointing authority, which would determine all other details about this process including what type of legal arguments may be pursued during trial, will be determined based on your geographic location. Under this agreement’s Terms, if any portion of the terms is deemed unlawful by a judge or arbitrator then that part will be stricken from it but not necessarily the rest.
You agree that the Terms are specifically enforceable by JobSpring through injunctive relief and other equitable remedies without proof of monetary damages.
In addition, if JobSpring does not exercise or enforce any legal right or remedy contained in these terms (or which it has under any applicable law), this will not be taken to be a formal waiver of its rights, but those rights or remedies remain available for use at our discretion.
The Terms are the entire agreement between us related to the subject matter in these documents. The Terms replace and supersede any other prior or contemporaneous agreements, representations or discussions, oral of written; they may not be changed except by a signed writing on behalf of both parties acting as an authorized representative with full authority for his/her company.
